VESSEL DRY – DOCKING TERMS AND CONDITIONS

  1. Dry docking is a narrow ship with an Indonesian or other flag that can load ships for ship maintenance and/or repair purposes.
  2. Vessels are vessels traded for certain activities on the Indonesian Supplies platform which are bound by these terms and conditions.
  3. Owner is a person who owns a ship and/or hires a contractor to maintain and/or repair a ship.
  4. Contractor is the party that performs maintenance and/or repair of the ship owned by the owner.
  5. Contractor’s work must comply with terms & conditions and normal working hours.
  6. The contractor shall endeavor to carry out all the work requested by the owner.
  7. The contractor may use employees or subcontractors to assist the contractor in completing his work.
  8. The contractor must have a People’s Shipping Sea Transportation Business Permit or other related permits and must be extended if the permit has expired.
  9. The owner must have a document, certificate, or special permit related to the ownership of the ship which will be dry docked and must be extended if the validity period expires.
  10. The owner or owner’s representative can visit and view the contractor’s work at any time.
  11. Owners and contractors are obliged to explain in detail about the type of work, goods used, delivery and processing times, costs and other related matters to Indonesian Supplies on paper.
  12. Once shipped, the ship must be placed in a safe place without risk of damage, defect or even loss of the ship by the contractor.
  13. Ships that are in a dry docking condition must be given strict care and maintenance by the contractor.
  14. If under certain circumstances the owner does not send the ship to the contractor with or without reason after the agreement is made, the contractor has the right to cancel his work to the owner and the owner must pay the amount of losses incurred by the contractor.
  15. If the contractor fails to start the work within 48 hours from that date, the owner has the right to cancel the work within 24 hours.
  16. Re-delivery may be done by agreement between the owner and contractor and must give written notice to Indonesian Supplies.
  17. Prices are determined by the contractor and must be approved by the owner. the owner can negotiate the price and/or get a discount under certain conditions.
  18. Payment can only be made in accordance with what is permitted and regulated in the terms and conditions of Indonesian Supplies.
  19. The contractor must provide a guarantee for a certain period of time for his work on board the ship owned by the owner by notifying Indonesian Supplies.
  20. In the event of force majeure, all rights and obligations of both parties may be suspended and may be resumed in accordance with force majeure rules in all terms and conditions of Indonesian Supplies.
  21. Indonesian Supplies is not responsible for any damage, loss, non-compliance, delay or other things that are detrimental to both the owner and manager caused by the fault and negligence of both parties.
  22. Every dry docking activity for Indonesian-flagged vessels must comply with the Regulation of the Director General of Sea Transportation No. HK.103/I/4/DJPL-15 concerning the Docking (Pelimbungan) of Indonesian-flagged Vessels and other related regulations.
  23. Each dry docking activity of this ship must comply with shipping safety standards as regulated in the Regulation of the Minister of Transportation of the Republic of Indonesia Number PM 20 of 2015 concerning Shipping Safety Standards and other related rules.
  24. If there is a dispute between the vendor and the buyer, it will be resolved through deliberation.
  25. If the dispute cannot be resolved through deliberation, then the Dispute can be submitted and finalized by arbitration in Indonesia, in accordance with the regulations of the Indonesian National Arbitration Board (BANI), which was established on November 30, 1977 based on the Decree of the Indonesian Chamber of Commerce No. SKEP/152/DPH/1977 in Indonesia using Indonesian.
  26. Indonesian Supplies reserves the right to modify or amend these terms and conditions without the approval of the Vendor.
