CHARTERING VESSEL WITHOUT CREW TERMS AND CONDITIONS

  1. Owner is the person who owns the ship.
  2. Charterers are people who rent ships for a certain period of time.
  3. Ship is a ship used to transport or carry certain goods.
  4. Vessels can be chartered for a certain period of time according to the agreement between the owner and charterer.
  5. Every ship to be chartered must be delivered by the owner at a place agreed upon by both parties and the ship must be in a safe and undamaged condition.
  6. Every ship to be chartered must have good documents and comply with all legal rules.
  7. The delivery of the ship by the owner and the takeover of the ship by the charterer must fulfill all the obligations stated in these terms and conditions.
  8. The ship owner must carry out due diligence to hand over the ship no later than a mutually agreed date.
  9. The rental cannot be canceled unless agreed by the owner and the lessee who made a written statement.
  10. Vessels must be used in lawful commerce for the legal carriage of merchandise within the regulated trade boundaries.
  11. The owner must provide the ship complete with equipment and other supporting tools such as oil when it is sent to the charterer. and if the charterer has finished using the ship, the charterer must return the ship to its original condition.
  12. The rental price of the boat is determined by the owner. the tenant can negotiate or get a discount if it meets certain conditions or has asked the owner directly.
  13. The owner does not provide crew for the charter of the ship.
  14. The parties may seek crews from third parties on terms and conditions agreed by the owners and tenants.
  15. Tenants may employ crew from third parties who are domiciled in the territory of Indonesia or elsewhere.
  16. Crew recruited from third parties must comply with Indonesian standards and must also comply with all terms and conditions in Indonesian Supplies.
  17. At the end of the charter period the vessel must be handed back by the charterer to the owner at a safe and frost-free port, at a ready and secure berth that can be directed by the owner. The lessee must give prior notice to the owner not less than 30 (thirty) days in advance of the expected date, the range of the retransmission port or port or place of retransmission not less than 14 (fourteen) days in advance of the exact date and port or place. which is expected. resend.
  18. The charterer must indemnify the owner against any loss, damage or expense incurred by the owner arising out of or in connection with the charterer’s operation, and against liens of any kind arising from an event occurring during the charterer’s period.
  19. All salvage and towage carried out by the ship is for the benefit of the charterer and the cost of repairing the resulting damage will be borne by the charterer.
  20. Every vessel charter activity must comply with shipping safety standards as regulated in the Regulation of the Minister of Transportation of the Republic of Indonesia Number PM 20 of 2015 concerning Shipping Safety Standards and other related rules.
  21. If there is a dispute between the vendor and the buyer, it will be resolved through deliberation.
  22. If the dispute cannot be resolved through deliberation, then the Dispute may be submitted and finalized by arbitration in Indonesia, in accordance with the regulations of the Indonesian National Arbitration Board (BANI), which was established on November 30, 1977 based on the Decree of the Indonesian Chamber of Commerce No. SKEP/152/DPH/1977 in Indonesia using Indonesian.
  23. Indonesian Supplies reserves the right to modify or amend these terms and conditions without the approval of the Vendor.
